👕 Custom T-Shirt Business Terms of Service (ToS)

This policy governs your use of services provided by Classi Custom Creations (referred to hereafter as "We," "Us," or "Our") for the design and production of custom apparel. By placing an order, you agree to these terms.

1. Order Acceptance and Fulfillment

1.1 Custom Order Details

All orders are binding upon acceptance by Us. We reserve the right to refuse any order at our sole discretion, including those that involve designs we deem objectionable, unlawful, or infringing on third-party rights (see Section 2).

1.2 Production Timeline

Production times provided are estimates and are not guaranteed, especially for large or complex orders. The timeline begins only after We have received full payment and you have provided final approval of the digital design proof.

1.3 Changes and Cancellations

• Before Proof Approval: Orders may be canceled, or changes requested, subject to a potential 0% processing fee to cover administrative costs.

• After Proof Approval: Production begins immediately after final approval. Cancellations or changes are generally not possible and may incur a full charge for materials and labor already expended.

2. Design and Intellectual Property Rights

This section covers the rights related to the artwork you submit and the final product.

2.1 Customer-Submitted Artwork

By submitting any artwork, images, logos, or text ("Artwork") for use on your custom apparel, you certify the following:

• You are the legal owner of the Artwork, or you have secured all necessary permissions and licenses to use it for commercial reproduction.

• The Artwork does not infringe upon the intellectual property, trademark, copyright, or privacy rights of any third party.

• You agree to indemnify and hold harmless Us from any and all claims, demands, costs, liabilities, and expenses (including legal fees) arising from the use of the Artwork provided by you.

2.2 Our Design Services

If We create or modify a design for you, We retain the copyright and ownership of the original design files and any underlying creative materials. You are granted a license to use the final printed product for its intended purpose. You may not reproduce or use the original design files outside of our service without explicit written permission and a separate licensing agreement.

2.3 Use of Final Product Images

You grant Us permission to photograph and use images of the final printed apparel for marketing, promotional purposes, and displaying examples of our work (e.g., on our website or social media), unless you specifically request in writing at the time of order placement that your order remain private.

3. Products and Colors

3.1 Garment Consistency

Garment availability may fluctuate. If the specific brand, style, or color initially ordered is unavailable, We reserve the right to substitute it with an equivalent product of comparable quality and features, upon notifying you.

3.2 Color Matching

We strive for accuracy, but variations occur. We do not guarantee exact color matching between the digital proof and the final printed garment due to differences in monitor settings, printing processes, and fabric dyes. We will use the agreed-upon industry-standard color values (e.g., Pantone codes) to achieve the closest possible match.

4. Limited Warranty and Liability

4.1 Returns and Refunds

Refunds and returns are governed by our Custom Item Refund Policy (as previously defined). Our liability is strictly limited to the cost of replacing the defective garment or refunding the price paid for that item.

4.2 Limitation of Liability

In no event shall We be liable for any indirect, incidental, special, or consequential damages (including, but not limited to, loss of profits or business) arising out of or in connection with the purchase or use of our custom products, even if We have been advised of the possibility of such damages.

5. Governing Law and Disputes

This policy shall be governed by the laws of Florida/ USA. Any dispute relating to these terms shall be resolved exclusively in the state or federal courts located in Palm Beach County /WestPalm Beach.
